A Family Spouse visa is a document that allows you to live with your spouse / partner for 30 months in the United Kingdom with a right to work there.

Further a Spouse visa must be extended for other 30 months, assuming that an applicant and his sponsor for the initial application still live together.

You can extend at any time before your current permission to stay in the UK expires.
If you apply in the UK a decision will usually be made within 8 weeks of your application date if you use the standard service.

General requirements

The requirements for a Spouse visa extension application are very similar to those for the original Spouse visa application.
Before applying for a Spouse visa extension, an applicant must check that he and his sponsor meet the general Home Office requirements listed below.

To apply for a Spouse visa extension, you need to:

– Have and be able to provide all general documents (please refer to the Documents section below on this page)

– Prove that the relationship between an applicant and his sponsor is genuine (the Genuine Relationship Test)
– An applicant and his sponsor must live together in the UK for the entire duration (30 months) of the original Spouse visa and stay in a legal marriage

– Prove a minimum income level (£29 000 per year), in accordance with the Home Office financial requirements

– Prove that an applicant meets the English language requirements (see below)

-Submit a document that confirms that a sponsor and an applicant have an accommodation to live in the UK, in accordance with the requirements of the Home Office

– Submit biometrics at the Visa Application Center

What is the Genuine Relationship Test?

An applicant for a Spouse visa extension must prove that the relationship between him and his sponsor is genuine.
The following documents may help to prove that the relationship is genuine:

– Evidence of shared bank accounts / shared financial responsibilities, such as a joint tenancy agreement or mortgage

– Documents from different sources sent in the name of an applicant and a sponsor to their residence address

– Photographs of the couple showing they have spent time together and with their relatives / friends during the last 30 months

– Cover letters from parents/friends confirming the relationship between an applicant and his sponsor is genuine

– Evidence of gifts or other goods bought for one another or for joint use (receipts)

– Any other documents showing that an applicant and his sponsor have lived together in the UK for the past 30 months

Financial Requirements

An applicant’s sponsor must prove his annual income is at least £29 000 before tax (gross annual income).

For each dependent child applying with an applicant, this increases to £3,800 for the first child and to £2,400 each for other children.

This income can come from:

– official employment in the UK

– employment

– self-employment (including directors of limited liability companies) in the UK

-self-employment
– savings (£62 500)

Some sources of income can be combined to meet the Home Office financial requirement for a spouse visa extension.

Knowledge of English (English Exam Test)

Spouse visa extension applicants must prove the ability to speak English at least A2 level.

In most cases, an applicant must pass an English language test and provide a certificate to prove his level. Those who studied in the UK at colleges or universities, can provide a diploma to prove a degree taught in English (a diploma must have a confirmation from UK NARIC).

The English test must be done through a registered provider – called a Secure English Language Testing (SELT) provider.
